The rule prohibited employers from discharging or discriminating against an employee for reporting a work-related injuries or illness. Post-incident drug testing policies and safety incentive programs would only violate 29 C.F.R. Incentive programs may be used to promote workplace safety and health. 1904.35 (b)(1)(iv).
